# Terms of service > Working draft, to be finalized with counsel before launch. Nothing here should be treated as a final legal commitment. Source: https://www.37lend.com/terms Last updated: September 25, 2026 ## What 37Lend is 37Lend is a funding marketplace. We help businesses find and compare financing from third-party lenders in our network. We are not a lender, we do not make credit decisions, and we do not guarantee that any lender will approve you, offer particular terms, or fund you. Nothing on 37Lend is financial, legal, or tax advice. The eligibility indications and comparisons in your account are there to help you understand your options; whether financing is right for your business is your decision. These terms are an agreement between you and 37Lend. By creating an account or using the service you agree to them and to our privacy policy (https://www.37lend.com/privacy). If you do not agree, do not use the service. ## Who can use 37Lend To use 37Lend you must: - be at least eighteen years old; - be applying on behalf of a business operating in the United States, and have the authority to apply for financing and to bind that business; - be seeking financing for business purposes only, not for personal, family, or household purposes; and - not be barred from using the service under any law that applies to you. By applying, you confirm each of these. ## Your account You sign in with a one-time code sent by text to your mobile number, with your email and a password, or with your Google or Microsoft account, so anyone who can use your phone, your password, or those accounts can reach yours. Keep them secure, sign out on shared devices, and tell us at once if you think someone else has used your account. You are responsible for what is done through it until you do. One person, one account. You may not let anyone else use yours, and you may not use anyone else's. ## Your application and the information you give us Everything you submit must be accurate, complete, and kept up to date. Lenders rely on it, and a false statement in an application for credit can be a crime. By submitting an application you authorize 37Lend, our funding platform partner, and the lenders your application is sent to: - to verify the identity of the business and of each owner and guarantor named on it; - to obtain consumer reports and business credit reports on the business and its owners, as a soft inquiry when you apply and, only if you accept an offer, as a hard inquiry by that lender; and - to share the application, the documents you upload, and the results of those checks among themselves for the purpose of evaluating and funding it. You confirm that each owner and guarantor whose information you enter has authorized you to provide it and to give these authorizations on their behalf. The authorizations you agree to in the application are recorded, with their version and the time, and you can read them on your account page. ## Electronic records and signatures 37Lend works entirely online. You agree that we, our funding platform partner, and lenders may give you notices, disclosures, agreements, and other records electronically, in your account, by email, by text, and in the mobile app, and that these have the same effect as paper. You agree that clicking, typing, or otherwise indicating agreement in the service is your electronic signature, under the federal Electronic Signatures in Global and National Commerce Act and state law. To receive electronic records you need a device with internet access, a current web browser or the mobile app, an email address or a mobile number that can receive texts, and the ability to view and save PDF files. You confirm you have these. Keep your contact details current so records reach you. You may ask for a paper copy of any record, at no charge, and you may withdraw this consent, by messaging your advisor. Withdrawing it means the service can no longer be provided to you and your open applications will be withdrawn; records already delivered electronically remain valid. ## Text messages If you sign in with your mobile number, you agree to receive one-time sign-in codes by text; signing in that way does not work without them. We send no other texts: news about your application reaches you in your account and, if you allow them, as push notifications. Message and data rates may apply. ## Offers and lenders Every offer in your account is made by the lender named on it, on its own terms, and is subject to its further verification and its final documents. An offer is not a commitment to lend until the lender says so in the agreement it sends you. Accepting an offer authorizes that lender's hard credit inquiry, declines your other open offers, and starts the lender's closing process. The financing agreement is between you and that lender; 37Lend is not a party to it, and the lender's terms govern the financing, its cost, and repayment. Read them before you sign. We do not control lenders' decisions, their timelines, or their terms, and we are not responsible for them. ## What it costs 37Lend does not charge businesses to apply, to receive offers, or to accept one. Lenders in our network may pay us a fee when financing they offered through the marketplace is funded, and that fee may differ by lender and product. Any fee a lender charges you is stated in its offer and its agreement, not here. ## Acceptable use You agree not to: - submit information that is false, misleading, or not yours to give; - apply for financing you do not intend to use for a business purpose; - access or try to access any account, application, or data that is not yours; - probe, scan, overload, or interfere with the service or the systems behind it, or use automated means to access it other than as we permit; - copy, resell, or build a competing service from the service or its content; or - use the service in any way that breaks the law or these terms. ## Intellectual property The service, its design, its text, and its software belong to 37Lend or its licensors. You may use them only to apply for and manage financing for your business. Anything you upload stays yours; you give us the right to store, process, and share it as this agreement and the privacy policy describe. If you send us suggestions, we may use them without owing you anything. ## Third-party services Lenders, our funding platform partner, sign-in and hosting providers, and the booking calendar are provided by other companies under their own terms and privacy policies. We are not responsible for them, and a link from our site is not an endorsement. ## Disclaimers The service is provided "as is" and "as available", without warranties of any kind, express or implied, including of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent the law allows. We do not warrant that the service will be uninterrupted or error-free, that any lender will make an offer, or that an eligibility indication will turn into one. ## Limitation of liability To the fullest extent the law allows, 37Lend and its officers, employees, and partners are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising from the service or these terms, however caused. Our total liability for any claim relating to the service is limited to the greater of one hundred dollars and the amounts you paid us in the twelve months before the claim. Some states do not allow these limits, in which case they apply to the extent permitted. ## Indemnification You will defend and indemnify 37Lend against claims, losses, and expenses, including reasonable legal fees, arising from information you submitted, your use of the service, or your breach of these terms or of the law. ## Dispute resolution and arbitration Talk to us first. If you have a dispute with 37Lend, tell us what it is and what you want, using the contact details below, and we will try to resolve it with you within sixty days. Arbitration. If we cannot, any dispute arising out of or relating to these terms or the service will be resolved by binding arbitration before a single arbitrator under the Commercial Arbitration Rules of the American Arbitration Association, rather than in court, except that either of us may bring an individual claim in small-claims court. The Federal Arbitration Act governs this section. The arbitrator may award the same remedies a court could, to you individually. No class actions. Disputes are resolved individually. You and 37Lend each waive the right to a jury trial and to take part in a class, collective, or representative action. Opting out. You may opt out of arbitration by telling us in writing within thirty days of first agreeing to these terms; the rest of the terms still apply. Disputes between you and a lender are governed by that lender's agreement, not this section. ## Governing law These terms are governed by the laws of the state in which 37Lend is organized and by applicable federal law, without regard to conflict-of-law rules. Subject to the arbitration section, any court proceeding will be brought in the state and federal courts located there, and you consent to their jurisdiction. ## Ending this agreement You can stop using the service at any time and can delete your account from your account page; the privacy policy explains what is kept afterwards and why. We may suspend or close your account if you break these terms, if the law requires it, or if we stop offering the service, and will tell you why unless the law prevents it. The sections on your application, intellectual property, disclaimers, liability, indemnification, disputes, and governing law survive. ## Changes to these terms We may update these terms. The date at the top shows the current version. For a material change we will tell you in your account or at the contact details we hold at least fourteen days before it takes effect, and continuing to use the service after that is acceptance. If you do not accept a change, stop using the service before it takes effect. ## Contact Questions about these terms, notices under them, and opt-outs from arbitration: message your advisor from your inbox if you have an account.
